16-year-old arrested in 2023 Dinuba homicide case

Tulare County District Attorney’s office apprehends male juvenile for murder of Cutler-Orosi educator Sergio Martin in November 2023

VISALIA – Almost six months after the death of Sergio Martin, a Dinuba-native who taught Spanish at El Monte Middle School in Orosi, the Tulare County District Attorney’s office has announced the arrest of his killer, who has been identified as a 16-year-old boy.

The male juvenile was arrested on April 24 following a thorough investigation from the Tulare County District Attorney’s Bureau of Investigations. He has been charged with murder and the special allegations of burglary, personal and intentional discharge of a firearm and use of a firearm.

Additionally, the defendant has been charged with a misdemeanor of receiving stolen property. He was arraigned in Tulare County Juvenile Court on April 26.

Sergio Martin was murdered in the early morning hours of Nov. 6, 2023. It is alleged the defendant shot the victim to death during a burglary in the victim’s home. Under California law, the juvenile cannot be tried as an adult because he was 15 years old at the time of the crime. State law also dictates the juvenile can only remain in custody until the age of 25 if he is convicted.

No further information can be disclosed at this time.

In addition to this arrest, two adult defendants, Jorge Arrieta, 21, and Joseph Garcia, 20, have been charged with felony second-degree burglary and felony accessory after the fact. Arrieta is further charged with misdemeanor receiving stolen property. The men are charged for their alleged conduct of entering Martin’s house after the murder occurred.

Both these individuals were arrested without incident on April 26 by the Tulare County District Attorney Bureau of Investigations with the assistance of the Dinuba and Reedley police departments. Arrieta remains in custody and is scheduled for arraignment as of this report. Garcia posted bail and will return to court on May 22 for arraignment.
